MPIA Partially Reverses WTO Ruling in EU-China IP Dispute
A panel of arbitrators under the Multi-Party Interim Appeal Arrangement has issued a ruling that partially reverses a prior World Trade Organization decision in a long-running dispute between the European Union and China over intellectual property enforcement practices. The case, which began in February 2022, centers on China's use of anti-suit injunctions that block European rights holders from pursuing IP challenges in European courts.
The MPIA arbitrators determined that Beijing's measures violated WTO rules, providing partial relief to the EU position while upholding other aspects of the original panel report. This development comes amid ongoing efforts to maintain a functional appellate mechanism for trade disputes following the paralysis of the WTO Appellate Body.
The ruling addresses the intersection of national IP enforcement tools and international trade obligations, with potential implications for how jurisdictions handle cross-border IP litigation strategies. Parties involved have not yet commented publicly on next steps following the decision.
