W.D. Wash. Issues Mixed Ruling in Breakthrough Solvent Mark Dispute

On June 1, 2026, the U.S. District Court for the Western District of Washington denied both parties' motions for summary judgment in Inland Technology Incorporated v. Allen Company Inc. The dispute centers on the BREAKTHROUGH mark registered by Inland in 1993 for industrial chemical solvents.

Inland alleged trademark infringement and unjust enrichment, claiming Allen's use exceeded any licensing arrangement and created consumer confusion. Allen argued its use was authorized under a prior agreement with Inland's predecessor distributor.

The court found genuine issues of material fact on likelihood of confusion and the existence or scope of any licensing agreement. Both motions were therefore denied, and the case will proceed to trial.

The decision highlights challenges in proving or disproving authorization and consumer confusion in distributor-mark disputes. Evidence of actual consumer confusion and the terms of any agreements will be key at trial.
