Volkswagen Fails to Block Rival's AI Space Trademark in EU
Volkswagen AG was unsuccessful in opposing a Chinese rival's application to register the trademark 'AI Space' before European Union authorities. The German automaker argued that the mark conflicted with its 'Allspace' brand but did not establish the required level of commercial use of Allspace in the EU during the relevant five-year period. EUIPO and reviewing bodies therefore allowed the application to proceed.
Opposition proceedings in the EU require the opposing party to demonstrate genuine use of its earlier mark or other grounds for refusal. Volkswagen's evidence fell short on proving active commercial exploitation of Allspace, a model name associated with its SUV lineup. The decision illustrates the strict evidentiary standards applied in EU trademark oppositions involving automotive brands.
The outcome allows the Chinese applicant to secure rights in the 'AI Space' mark for relevant goods and services. This case reflects ongoing challenges for established brands seeking to protect marks across classes when prior use evidence is limited or dated.
