Van Leeuwen Wins $23.8M in Rebel Creamery Trademark Ruling

U.S. District Judge Eric Komitee issued a ruling on July 17 finding that Rebel Creamery's ice cream packaging infringed Van Leeuwen's trademarks and trade dress. The court determined the Utah-based company's low-sugar ice cream pints used confusingly similar pastel monochrome designs and black cursive script.

Van Leeuwen filed the lawsuit in the Eastern District of New York in 2021. The judge concluded Rebel acted in bad faith, noting testimony about independent design was fabricated. Some consumers and professionals had been confused by the similar packaging.

The ruling orders Rebel to redesign its pints. Spokespeople for both companies did not immediately comment. The case is Van Leeuwen Ice Cream LLC v. Rebel Creamery LLC, No. 1:21-cv-02356.
