USPTO Sees Rise in Coordinated Trademark Swarm Filings

A law firm specializing in international trade has documented an emerging pattern of coordinated bad-faith trademark filings at the U.S. Patent and Trademark Office. In the past week, the firm encountered two separate matters involving clusters of five applications each, all filed on the same day by different entities for marks identical or highly similar to legitimate brands that had not yet registered in the United States.

The filings appear designed to create standing on e-commerce platforms and complicate enforcement for brand owners. Although many such applications are ultimately refused or abandoned by the USPTO, the activity generates immediate costs and delays for affected companies. The firm described the tactic as a new variant of trademark squatting that leverages the appearance of unrelated applicants to mask coordination.

Brand owners are advised to monitor the USPTO database closely and consider defensive filings in key classes even before entering the U.S. market. The practice highlights ongoing challenges in detecting and deterring speculative filings under current examination procedures.
