UND Opposes Resident's Fighting Sioux Trademark Bids

Tyler Wilson, a Grand Forks resident, filed trademark applications in 2025 for “FIGHTING SIOUX,” “SIOUX,” and the historic side-profile Fighting Sioux logo for use on apparel and related goods. The University of North Dakota has filed notices of opposition against the “FIGHTING SIOUX” and logo applications, asserting common law rights and a 1994 North Dakota state registration renewed in 2024. Wilson’s counsel has responded with claims that UND abandoned the marks and never held federal registrations.

The “SIOUX” application remains suspended pending resolution of a separate cancellation proceeding against a similar registered mark owned by SIUX Brands World. Wilson’s filings seek to establish rights that could support an NIL fund for athletes if granted. UND has stated it strongly disputes the applications and is addressing them through legal channels. The university retired the Fighting Sioux nickname and logo in 2012 following NCAA policy changes.

The proceedings continue at the USPTO with ongoing exchanges between the parties.
