UK Court Orders Samsung to Pay Swatch $11.6M in Trademark Case
A UK High Court has ordered Samsung Electronics to pay Swatch Group approximately $11.6 million in damages for trademark infringement related to third-party smartwatch applications.
The ruling, issued Wednesday, stems from apps available on Samsung's Galaxy app store between 2015 and 2019 that replicated designs from Swatch Group brands including Breguet, Blancpain, Omega, Longines, and Tissot. The court previously found Samsung liable for infringement, and the recent decision quantified damages after a trial on that issue.
Swatch had sought up to $170 million, while Samsung argued any award should not exceed a few hundred dollars. Judge Marcus Smith described the unauthorized use of the brands on accessible digital platforms as very damaging to the Swiss watchmaker's interests.
Samsung stated it is considering all options, including an appeal. The apps were developed by third parties, but Samsung was held responsible due to its control over the app review and distribution process.
