TTAB Upholds Refusal of Descriptive Delivery Robot Mark
The Trademark Trial and Appeal Board upheld the USPTO's refusal to register the proposed mark FIND - FETCH - TRANSFER for self-driving robots for delivery services. The Board found the mark merely descriptive under Section 2(e)(1) of the Lanham Act, citing the applicant's own website and arguments as particularly compelling evidence of how the relevant public would perceive the phrase. The decision, issued September 1, 2026, in In re Drobot, Inc., Serial No. 99010898, is not precedential. The Board noted that the mark directly describes the functions performed by the goods. Applicant Drobot had argued the mark was suggestive, but the Board disagreed, emphasizing the immediate descriptive meaning conveyed to consumers in the field of autonomous delivery technology. This ruling reinforces the high bar for marks that describe the purpose or function of technology products. The decision provides guidance on the use of an applicant's own materials in descriptiveness analyses.
