TTAB Upholds Genericness Refusal for Neuropsychiatric Services Mark

26 August 2026

An Illinois psychiatric practice sought registration of Neuropsychiatric Services, S.C. on the Supplemental Register for psychiatric services, outpatient and inpatient care, behavioral health services, and neuropsychiatric testing. The USPTO refused the mark as generic.

On August 25, 2026, the TTAB affirmed the refusal after finding the evidence of genericness overwhelming. The Board concluded that each element of the proposed mark simply names the services provided without adding any distinctive source-identifying function.

The decision reinforces that terms directly describing the nature of professional services face high hurdles for registration, even on the Supplemental Register. The ruling aligns with established principles that marks must distinguish source rather than merely identify the service category.
