TTAB Rules Tribal Immunity No Bar to Trademark Challenges

13 October 2026

The Trademark Trial and Appeal Board issued a precedential order on September 18, 2026, denying a motion to dismiss a cancellation proceeding brought by Philip Morris USA Inc. against four tobacco-related trademark registrations. The respondent, Sycuan Tribal Development Corporation, had argued that tribal sovereign immunity barred the Board from exercising jurisdiction after the marks were assigned to the tribal entity.

The Board concluded that tribal sovereign immunity does not apply in TTAB inter partes proceedings. It reasoned that such proceedings are administrative actions to determine rights to federal registration and do not involve personal jurisdiction over parties, monetary damages, or injunctive relief against use. Allowing immunity would permit gamesmanship to shield potentially invalid registrations from review, contrary to the purposes of the Trademark Act.

The decision aligns with prior rulings rejecting similar immunity claims in patent review proceedings and state sovereign immunity defenses in trademark matters. The underlying cancellation claims of abandonment and naked licensing remain pending, with proceedings suspended pending further status updates.

The ruling establishes that federal trademark registrations owned by tribal entities remain subject to administrative challenges before the Board.
