TTAB Blocks Lamar Jackson 'ERA 8' Trademark Bid
In a decision issued August 27, 2026, and noted September 2, the TTAB dismissed opposition proceedings involving Lamar Jackson’s application for the mark ERA 8 BY LAMAR JACKSON. The board applied claim preclusion to bar registration for most goods in Classes 18 and 25.
For the remaining goods—carry-on bags and travelling bags—the board found the mark had not been used in commerce prior to the filing of the use-based application, rendering it void ab initio.
The opposition was brought by New Era Cap, LLC. Jackson, who wears jersey number 8, sought registration for athletic bags, backpacks, clothing, footwear and related items.
The ruling underscores the importance of establishing prior use for use-based applications and the preclusive effect of prior TTAB determinations.
