The U.S. Supreme Court has granted certiorari in a dispute between canned-coffee maker Rise Brewing and PepsiCo over the name 'Mtn Dew Rise.' Rise Brewing alleges that the PepsiCo product infringes its trademarks and creates consumer confusion with its coffee brand.
A lower court had rejected the claims, prompting Rise's appeal. The high court will examine issues related to trademark liability for product names in the beverage sector.
The case could clarify standards for assessing likelihood of confusion in competing consumer goods.
