Philippine Supreme Court Bars Similar 'W' Hotel Marks

The Supreme Court of the Philippines on June 1, 2026, reversed lower court and intellectual property office decisions, holding that Oceanic Empire Limited's marks "W GLOBALCENTER," "W FIFTH AVENUE," and "W TOWER" are confusingly similar to Starwood Hotels & Resorts Worldwide, LLC's stylized "W" marks for hotel and entertainment services.

Justice Ramon Paul L. Hernando wrote the decision for the First Division. The court applied the dominancy test, finding the prominent stylized "W" the dominant feature in both sets of marks. Added descriptive words did not dispel similarity, and the businesses were deemed related because both involve high-end property development and branding.

The ruling emphasized that only a likelihood of confusion is required under the Intellectual Property Code. Starwood's marks had been registered for hotel services, while Oceanic sought protection for real estate projects. The court directed the Bureau of Trademarks to deny Oceanic's applications and cancel the "W TOWER" registration.

The decision underscores Philippine trademark law's focus on visual resemblance and marketplace presentation over minor textual differences or industry distinctions when services overlap in consumer perception.
