Perplexity Trademark Dispute Returns to TTAB After Court Collapse

5 September 2026

A trademark dispute between two software firms both operating under the name Perplexity collapsed in federal court after months of procedural back-and-forth, resulting in the case being returned to the Trademark Trial and Appeal Board.

The federal action was dismissed on procedural grounds, leaving the opposition or cancellation proceedings at the TTAB to continue. The companies had been litigating rights to the Perplexity mark in connection with AI-related software services.

No substantive ruling on likelihood of confusion or priority was reached in the district court. The TTAB proceedings will now address the core trademark issues.

The outcome underscores the interplay between federal court litigation and administrative trademark proceedings when parallel actions are filed.
