Perplexity Trademark Dispute Collapses, Returns to TTAB
A U.S. federal court has dismissed a trademark infringement action between two companies using the name Perplexity, remanding the matter to the Trademark Trial and Appeal Board. The procedural collapse occurred after months of filings and disputes over jurisdiction and standing.
The case involved Perplexity AI Inc. and another software entity both operating under similar branding for AI-related services. The court found procedural deficiencies that prevented adjudication on the merits in federal district court.
The TTAB proceedings will now address the core issues of trademark rights, priority, and likelihood of confusion in the AI software sector. The remand follows earlier attempts by one party to resolve the conflict through settlement or transfer.
The decision underscores the challenges in litigating name disputes involving emerging technology brands where multiple entities claim rights to descriptive or coined terms.
