MLB Teams Oppose WNBA 'The W' Trademark Bid
The Chicago Cubs and Washington Nationals have teamed up to oppose the WNBA's bid to register 'The W' for apparel. The teams argue that the proposed mark is likely to be confused with their longstanding 'W' trademarks.
The opposition was filed with the Trademark Trial and Appeal Board and reported on August 14, 2026. Both baseball clubs have used 'W' marks in connection with clothing and related merchandise for decades.
In their filing, the teams contend that the marks are similar in appearance and that the goods overlap, creating a risk of consumer confusion. The WNBA's application covers apparel items.
TTAB oppositions allow third parties to challenge pending applications during the 30-day publication period. This case involves sports organizations protecting established marks against a new entrant in the apparel category.
The proceeding will examine standard likelihood-of-confusion factors under the Lanham Act. No decision has been issued yet.
