Magistrate Denies Stay in Bahá’í Trademark Judgment

14 October 2026

A federal magistrate judge in Colorado denied a defendant’s request to stay enforcement of a trademark judgment pending appeal. The ruling leaves in place an order directing the individual to transfer a domain name to the U.S. organization representing Bahá’í worshippers.

The underlying dispute was resolved earlier this year when the magistrate determined that the defendant’s loss before the Trademark Trial and Appeal Board controlled the outcome of the federal trademark claims. Judgment was entered in favor of the religious organization, which had prevailed on claims involving its marks.

The defendant sought a stay of the judgment’s execution, including the domain transfer obligation, while pursuing an appeal. The magistrate rejected the request, finding insufficient grounds to halt enforcement at this stage.

The decision underscores the finality of TTAB outcomes in subsequent federal court proceedings when parties fail to demonstrate a likelihood of success on appeal or other stay factors.
