Madras High Court Dismisses Amul Trademark Suit

The Madras High Court dismissed a trademark infringement action brought by Asian Beverage against Gujarat Cooperative Milk Marketing Federation Ltd, known as Amul, concerning the AMUL TRU mark.

The court held that the plaintiff failed to comply with the mandatory notice requirement under the Gujarat Cooperative Societies Act before initiating proceedings against the cooperative.

The ruling underscores procedural hurdles in suits targeting Indian cooperatives and ends the immediate challenge to Amul’s use of the mark on dairy products.

Amul is one of India’s largest and most recognized dairy brands, with extensive trademark protection across food and beverage categories.
