Kerala HC Upholds Injunction in LAZZA vs HAZZA Mark Dispute

8 October 2026

The Kerala High Court dismissed an appeal by Taste Box, operator of HAZZA Kitchen restaurant in Kalamassery, against an interim injunction granted by the II Additional District Court, Ernakulam. Justice S. Manu, in a judgment dated April 10, 2026, found the mark HAZZA Kitchen deceptively similar to the LAZZA trademark owned by JSF Holdings Private Limited for ice creams, frozen desserts and related products.

The court held that the dominant features of the marks created a likelihood of confusion among consumers. It rejected arguments that the trial court order suffered from any material irregularity warranting interference. The appeal was dismissed with no order as to costs, leaving the injunction in place pending final disposal of the suit.

The ruling reinforces protection for well-known food and beverage marks in India against similar uses in related classes. The injunction prevents the restaurant from operating under HAZZA or any deceptively similar mark.
