India Accepts First Smell Mark Application for Rose-Scented Tires

10 October 2026

The Indian Trade Marks Registry has moved an application for a rose scent used on tires into the advertisement stage, representing the first olfactory trademark to clear this procedural hurdle in India. The filing employs a scientific mapping of the scent into a seven-dimensional olfactory space to satisfy the graphical representation requirement.

The acceptance signals potential openness to non-traditional marks beyond conventional word and device signs. The application covers tires and addresses the longstanding challenge of depicting smells in a reproducible manner for examination purposes.

Observers note that the use of scientific visualization alongside the scent description may provide a model for future sensory mark applications in the jurisdiction.
