EUIPO Updates Examination Guidelines for EUTMs and EUDs

7 September 2026

The European Union Intellectual Property Office implemented the 2026 edition of its Guidelines for Examination of European Union trade marks and registered Community designs. The updated guidelines, adopted by Executive Director Decision No EX-26-09 on June 30, 2026, reflect current Office practice following stakeholder consultation. Key changes include updated graphic representation requirements for designs, alignment with recent General Court and Court of Justice judgments on geographical indications, and clarifications on evocation and imitation practices. The guidelines also incorporate case law confirming that an earlier right must remain valid until the date of the opposition decision. These revisions aim to provide clearer guidance for applicants and practitioners navigating EUTM and EUD examinations. The updates address evolving issues in design representation and GI protections amid recent legislative and judicial developments.
