EUIPO Accepts New Design Representations from July
From 1 July 2026 the EUIPO began accepting dynamic 3D representations and animated representations for design applications. The change forms part of the second phase of EU designs reform.
The update also addresses proof of use requirements when invalidity claims are based on earlier trademarks. Owners of contested designs may request proof of use for two five-year periods.
The provisions align invalidity proceedings for designs more closely with established trademark practices. Applicants must demonstrate use where the rule requires it.
The reform applies to new filings and certain ongoing matters. No specific opposition cases or settlements were reported in connection with the rollout.
