Delhi High Court Cancels Grand Masti Liquor Mark

14 September 2026

The Delhi High Court has cancelled the trademark registration for GRAND MASTI in Class 33 for country liquor, finding it deceptively similar to Radico Khaitan Ltd.’s established MASTIH mark. Justice Manmeet Pritam Singh Arora allowed the rectification petition and directed removal of Registration No. 4832282 from the register.

Radico Khaitan presented evidence of substantial sales and reputation under MASTIH, with turnover exceeding Rs 1,500 crore in recent years. The court noted that the dominant element MASTI in the impugned mark, combined with phonetic similarity to MASTIH, created a likelihood of confusion among consumers.

The respondent’s mark featured GRAND in smaller font, directing attention to the shared MASTI component. The ruling emphasizes that minor additions or stylistic differences do not overcome similarity when the core elements overlap significantly in the alcoholic beverages sector.

This rectification strengthens enforcement options for established liquor brands against later registrations that risk diluting distinctive marks. The decision aligns with precedents requiring careful examination of dominant features in composite marks.
