Delhi High Court Approves Mars-Cadbury 'Celebrations' Settlement
The Delhi High Court approved a settlement agreement between confectionery companies Mars and Cadbury, concluding a long-running trademark dispute over the word 'Celebrations' for assortments of sweets. Justice Sanjeev Narula noted that the parties had resolved all claims after nearly 25 years of litigation that began with an opposition in the Trade Marks Registry.
Under the terms, both companies will withdraw their pending opposition and rectification proceedings. The agreement includes mutual releases from further claims related to the mark. The court decreed the suit in accordance with the settlement.
As part of the resolution, Mars and Cadbury each committed to donating confectionery assortments valued at Rs 5 lakh to children in government and government-aided schools in Delhi ahead of Diwali.
The case originated from Mars filing suit in 2018, building on earlier registry proceedings dating back decades.
