Delaware Court Issues Partial Twitter Trademark Injunction
The US District Court for the District of Delaware granted X Corp a partial preliminary injunction on September 3, 2026, in its trademark dispute with startup Operation Bluebird. The order prevents Operation Bluebird from using the 'Twitter' name for its planned social networking platform but does not extend protection to the 'tweet' word mark or the bird logo.
Chief Judge Colm F. Connolly ruled that X Corp was likely to succeed on its claims regarding the 'Twitter' mark. However, the court found that Operation Bluebird was likely to succeed in showing that the 'tweet' mark and bird logo had been abandoned by X Corp. Evidence of continued use presented by X Corp consisted largely of outdated materials, including old webpages, dormant social media accounts, and a deactivated @twitter account.
Operation Bluebird had filed intent-to-use applications for 'TWITTER' and 'TWEET' with the USPTO and announced a platform at twitter.new. The injunction requires X Corp to post a USD 500,000 bond. The case stems from a lawsuit filed by X Corp in December 2025.
