Court Upholds Refusal of 'Ignite' Mark for Vodka, Tequila
The US District Court for the Eastern District of Virginia issued a detailed opinion on September 11 affirming summary judgment for the USPTO in a challenge by Ignite International Ltd. The company had sought to register 'Ignite' for vodka and tequila products. Judge Patricia Tolliver Giles applied the Fourth Circuit's nine-factor likelihood-of-confusion test and found the marks sufficiently similar in sight, sound, and meaning. The court noted that both marks target overlapping alcoholic beverage consumers and that the shared dominant term 'Ignite' created a strong impression of relatedness. Sazerac Brands owns the prior 'Ignite the Nite' registration covering whiskey-based liqueurs. The ruling provides additional reasoning beyond an earlier March order granting the agency's motion. No appeal details were immediately available.
The decision underscores the USPTO's strict approach to alcohol marks sharing common wording even across different spirit categories.
