Court Denies Adobe Dismissal in Foundry Trademark Suit
The U.S. District Court for the Northern District of California denied Adobe Inc.'s motion to dismiss a trademark infringement suit brought by London-based Foundry Visionmongers Ltd. In a September 8, 2026 order, Judge Noël Wise held that the plaintiff had adequately alleged a likelihood of consumer confusion between its longstanding "Foundry" marks and Adobe's use of "Firefly Foundry" for competing AI content creation models.
Foundry Visionmongers, which provides software used by major film studios including Walt Disney Animation Studios, Marvel, and Netflix, filed the action in March 2026. The company claims Adobe launched the models under a name that infringes its registered and common-law trademarks in the visual effects and post-production software field.
The decision allows the case to proceed on the core infringement allegations. Adobe had argued that the claims failed as a matter of law, but the court found the pleadings sufficient at this stage.
