Vogue Succeeds in Blocking Next Vogue Trade Mark

The owners of the Vogue fashion magazine have successfully opposed a UK trade mark application for “Next Vogue” in respect of pet toys and related goods. UKIPO hearing officers found a likelihood of confusion, concluding that consumers might assume the pet products formed part of a new range from the well-known fashion title. The opposition succeeded on relative grounds, preventing registration of the mark. The decision underscores the strength of established magazine brands when protecting against similar signs in unrelated sectors where brand extension is plausible. No appeal has been reported.

Small businesses should run comprehensive clearance searches across classes before filing to avoid costly oppositions from household names.
