UKIPO Rules on EFC Figurative Mark Opposition

The UK Intellectual Property Office issued a decision on 6 August 2026 in opposition proceedings concerning the figurative mark EFC. The application covered a wide range of classes including cosmetics, electronics, vehicles, jewellery, luggage, clothing, sporting goods, alcoholic beverages, retail services, financial services, telecommunications and entertainment. The opposition relied on earlier trade marks under sections 5(1), 5(2) and 5(3) of the Trade Marks Act 1994, raising issues of similarity between marks, goods versus retail services, reputation and dilution. Passing off under section 5(4) was also pleaded. Hearing Officer Mr Arran Cooper delivered the ruling following standard registry procedure.

This case illustrates the detailed assessment required when opposing marks across multiple classes and the importance of clear evidence on reputation and similarity.
