UKIPO partially revokes Frasers marks in major consolidated case

The UK Intellectual Property Office has issued a substantial decision in consolidated revocation, invalidation and opposition proceedings involving multiple marks incorporating the term FRASERS. The Registrar considered over thirty actions brought by Frasers Property Limited against House of Fraser Brands Limited and related parties. Partial revocations were ordered on grounds including non-use, while certain oppositions succeeded in preventing registration in classes covering property, financial and accommodation services. The outcome requires adjustments to branding strategies by the affected parties. Small businesses should maintain clear records of trade mark use across all registered goods and services to defend against non-use challenges.
