UKIPO Rules on Gluggle Jug Invalidity Action

The UK Intellectual Property Office has issued a decision in invalidity proceedings concerning marks for Gluggle Jug and The Original Gluggle Jug in class 21. The action, decided on 4 August 2026 by Hearing Officer Ms Leisa Davies, raised grounds including bad faith under section 3(6) of the Trade Marks Act and passing off under section 5(4). Issues addressed encompassed knowledge of prior use in the UK, alleged breaches of agreements or fiduciary duties, breakdown of a former business relationship, and questions of acquiescence and contract construction. The proceedings also involved consolidation and evidential matters relating to the relevant date and standard of proof for earlier rights. The outcome turned on detailed examination of the parties' commercial history and the timing of the applications.
