Chanel Prevails in EUIPO Opposition Over No.5 Bottle Shape
The European Union Intellectual Property Office Opposition Division has upheld Chanel’s opposition to a 3D trademark application filed by Romanian company Chaos Perfumes. The decision, issued October 9, 2026, rejects the application for a white-and-gold bottle design bearing the words “CHAOS ANGELIC TOUCH EAU DE LIGHT.”
Chanel relied on its earlier French registration for the iconic No.5 bottle shape. Although the contested design was found visually and conceptually similar to only a low degree, the office determined that the later mark would take unfair advantage of the reputation of Chanel’s mark under Article 8(5) of the EU Trade Mark Regulation. Evidence of reputation included a 2016 survey of French consumers and the bottle’s appearances in art and advertising.
The goods were identical, covering perfumery and related items. The ruling rejected the application in full and ordered the applicant to pay costs.
