Argentina Issues New Rules on Trademark Opposition Resolution

Argentina’s National Institute of Industrial Property (INPI) has approved new regulations governing the administrative resolution of trademark oppositions. Resolution No. 297/2026, published in the Official Gazette on August 10, 2026, replaces prior annexes and applies to oppositions filed against applications submitted from March 1, 2026 onward.

The updated framework sets out revised procedures, timelines, and requirements for parties during the opposition stage before INPI. It aims to streamline administrative review while maintaining fairness for applicants and opponents.

The resolution was issued on August 6, 2026, and introduces standardized processes for evidence submission, hearings, and decision issuance in opposition matters. Existing opposition proceedings continue under the previous regime.

Stakeholders in the Argentine IP community are reviewing the changes for impacts on filing strategies and response deadlines. The move follows earlier updates to nullity proceedings and reflects ongoing efforts to modernize trademark administration.

The regulations seek to enhance predictability and efficiency in resolving disputes at the administrative level before potential court appeals.
