American Eagle Sued Over 'Overslept' Sleepwear Mark

A New York-based sleepwear company filed suit in New York federal court on September 16, 2026, claiming American Eagle Outfitters infringed its registered 'Overslept' trademark by launching a line of sleepwear under the same name. The plaintiff asserts prior registration and use of the mark for apparel.

The complaint alleges that American Eagle's adoption of the mark creates a likelihood of consumer confusion as to source and affiliation. It seeks injunctive relief to stop the sales and marketing of the accused products along with damages.

American Eagle has not yet responded publicly to the allegations. The case adds to recent disputes involving established marks in the apparel and sleepwear categories.
