Amazon Flags Potential Abuse in Chicago Schedule A Trademark Suits
Amazon has filed motions in the U.S. District Court for the Northern District of Illinois to pause court-ordered fund transfers in more than a dozen trademark enforcement actions brought against large numbers of online sellers. The retailer, not a party to the suits, is investigating whether some plaintiffs used the litigation to access funds Amazon had previously frozen for unrelated reasons.
The actions follow the common Schedule A format used in mass joinder trademark and counterfeiting cases in the district. Amazon stated it is examining patterns that may indicate abuse of the process, including the timing and purpose of asset restraints.
The motions come amid broader scrutiny of Schedule A litigation practices, including concerns over procedural fairness and enforcement mechanisms in online marketplace disputes.
